Please read these Terms of Service ("Terms") carefully before using ColonyRush (the "App") operated by Superbigly Inc. ("we", "us", or "our"). By using the App, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using ColonyRush, you agree to be bound by these Terms. If you do not agree, do not use the App.

You must be at least 13 years old to use ColonyRush. By using the App, you represent that you meet this requirement.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You must provide accurate information when creating an account.
You may not create accounts for others without their consent or use another person's account.
Notify us immediately at support@colonyrush.com if you suspect unauthorized access to your account.

3. Acceptable Use

You agree not to:

Cheat, exploit bugs, or use unauthorized software to gain an unfair advantage
Harass, abuse, or threaten other players
Use the App for any illegal purpose
Attempt to reverse-engineer, decompile, or modify the App
Interfere with or disrupt the App's servers or networks
Use automated bots or scripts to play the game
Sell, trade, or transfer your account to another person

4. Subscriptions and In-App Purchases

ColonyRush offers optional paid subscriptions ("Pro") that unlock additional features. Subscriptions are billed through the Apple App Store or Google Play Store.

Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Cancellation: Cancel through your device's App Store or Play Store subscription settings.
Refunds: Refund requests are handled by Apple or Google according to their respective policies. We do not issue refunds directly.
Price changes: We may change subscription prices with reasonable notice. Continued use after price changes constitutes acceptance.

All purchases are final once processed. Virtual items, credits, and subscription benefits have no monetary value and cannot be transferred or exchanged for real currency.

5. User-Generated Content

Display names and in-game communications ("User Content") you submit must comply with these Terms.

You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute it in connection with the App.

We may remove User Content that violates these Terms or that we deem inappropriate at our sole discretion.

6. Intellectual Property

The App and its content — including graphics, game logic, sounds, and text — are owned by Superbigly Inc. and protected by intellectual property laws.

ColonyRush is an original digital strategy game. The term "Catan" and related marks are trademarks of Catan GmbH and are not affiliated with or endorsed by Superbigly Inc.

You may not reproduce, distribute, or create derivative works from any part of the App without our written permission.

7. Termination

We may suspend or terminate your account at any time for violation of these Terms, harmful conduct, or for any other reason at our discretion, with or without notice.

You may delete your account at any time through the App settings or by contacting support@colonyrush.com.

Upon termination, your right to use the App ceases immediately. Active subscription benefits will continue until the end of the current billing period per the App Store or Play Store policy.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses.

We are not responsible for lost game progress due to device issues, network failures, or App updates.

9. Limitation of Liability

To the fullest extent permitted by law, Superbigly Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $10, whichever is greater.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, via an in-app notification. Continued use of the App after changes constitutes acceptance of the new Terms.
